Cross-Market Hospital Mergers: The Next Frontier in Antitrust Enforcement? - On Demand Recording

Since antitrust enforcement of hospital mergers began, federal antitrust agencies have expressed concern primarily with mergers of hospitals in the same geographic market.  Until recently, there has been little attention paid to cross-market hospital mergersi.e., mergers of hospitals spanning multiple markets and serving distinct patient populations.  However, new economic research concludes that such mergers may indeed harm competition and result in higher prices.  This roundtable discussion is designed to provide both a legal and economic perspective on cross-market pricing effects of hospital mergers.  The speakers plan to address instances in which cross-market effects become relevant, the extent to which these analyses may become part of an Federal Trade Commission FTC hospital merger investigation, the corresponding theories of harm, and the potential challenges of bringing cross-market cases.
