The government has noted in its guidelines on physician compensation that responsibility for determining fair market value ultimately rests with the parties to the arrangement and that health care organization must have in place processes for making and documenting reasonable, consistent and objective determinations of fair market value. In order to meet these obligations, health care organizations must develop a right-sized process that can be implemented effectively and consistently. This webinar will survey a continuum of approaches (both internal and external) for determining and documenting fair market value and commercial reasonableness, including a practical discussion about new industry tools that are being incorporated into physician compensation processes.
Highlights of the webinar will include:
- Internal processes for determining and documenting fair market value and commercial reasonableness.
- Developing best practices for engaging appraisal firms to perform external analyses, including strategies to enhance defensibility, efficiency and confidentiality throughout the valuation process.
- An overview of the resources and tools available to support fair market value, from salary surveys, to compensation calculators to customized tools available in the industry.
Level of Difficulty: Intermediate/ Advanced
Intermediate-level programs generally offer focused discussions regarding common legal issues pertaining to the program topic. Intermediate programs include legal updates and changes in the law. Speakers will assume the audience has a working knowledge of this specialty of health law, and there will be limited review of the fundamentals. This program is designed to provide a targeted, comprehensive analysis of the subject matter for those practicing law in this specialty for three to seven years and/or those whose practice is periodically focused in the covered subject area.
Advanced-level programs offer in-depth discussions regarding complex legal issues and review special nuances of a subject matter. There will be no review the fundamentals of the law, and speakers will assume the audience is very knowledgeable about this specialty of health law. This program is designed to provide a narrowed, highly technical analysis of the subject matter for those practicing health law in this specialty eight or more years and/or those whose practice consistently and intensely focused in the covered subject area.
